An article 78 proceeding under the CPLR has been brought before this court on behalf of a policeman of the City of Oneonta Police Department for a review of the proceedings, acts and determination of the Board of Public Safety of the City of Oneonta.

After a hearing held before said board, the petitioner was found guilty of the charge, and was punished by a forfeiture of 10 days' pay.
