This is an appeal in a criminal action wherein the appellant was charged as principal and as an accessory before the fact with the offense of aggravated assault upon a guard at the Kansas State Penitentiary (K.S.A. 21-431). Judgment and sentence were pronounced after the appellant entered a plea of guilty.
