The defendant was charged with, and convicted of, breaking and entering a dwelling in North Haven in the daytime on June 28, 1968, in violation of General Statutes § 53-73. The defendant was apprehended by the North Haven police in the vicinity of the entered dwelling at about 10 p.m. on June 28.
