Harold Rushe, plaintiff, fell down a stairway in his home on November 5, 1960, as a result of which he dislocated the second cunieform bone of his right foot. Dr. Francis J. O'Malley, defendant, hospitalized plaintiff and performed a surgical operation on plaintiff's foot on the day of the accident and, five days later, performed a second operation on that foot. Defendant continued to treat plaintiff at his medical office after plaintiff...
