In this action the plaintiffs seek to recover money damages from the United States and certain of its officers and agents in the Armed Forces for the death of their son in Vietnam.

The complaint alleges that the plaintiffs' decedent, Russell J. Rotko, Jr., enlisted in the Marines on March 14, 1967. In February of 1968 he was wounded in Vietnam, transferred to Japan for medical treatment, and in March...
