This is a concursus proceedings. The plaintiff, Western Surety Company, issued a surety bond in the sum of $25,000 to James Mallett for the faithful performance of his duties as a warehouseman under the provisions of LSA-R.S. 54:1, et seq. After the warehouseman defaulted on many of his obligations, plaintiff filed the present concursus proceedings and deposited in the registry of the court the sum of $25,000.
