This is an appeal from a judgment dismissing a writ of habeas corpus by which defendant sought to test the validity of his confinement in the State Prison arising out of a conviction for sodomy in 1955. The issue is whether the commissioner of corrections could assume jurisdiction over petitioner without a determination by the Youth Conservation Commission before his 25th birthday that his discharge would be dangerous to the public.
