DIXON, Justice.

By information, it was charged that appellant and another "unlawfully did violate R.S. 40:1033(8) in that they obtained a central nervous system drug, to-wit: Soconal, by the use of a false name and the giving of a false address, * * *." Defendant waived his right to a jury trial, and the case came on for trial. While examining one of the State's witnesses, a pharmacist, the assistant district attorney learned that the correct spelling of the drug...
