This is an appeal from a sentence and judgment of the Franklin County Municial Court, entered on December 28, 1970.

The facts are that appellant was given a citation by State Highway Patrolman G. H. Jones on May 31, 1969. At that time, he was wearing a cloth-type fabric cap, described as "a motorcycle dress cap."
