BUSSEY, Presiding Judge.

This is an appeal by Robert Arthur Winn, hereinafter referred to as defendant, from a conviction in the District Court of Oklahoma County of the crime of Burglary Second Degree, After Former Conviction of a Felony. Trial was held to a jury which found the defendant guilty, and fixed punishment at 27 years in the penitentiary. Judgment and sentence followed accordingly. This Court granted post conviction relief to allow an appeal.
