On the night of September 14, 1968, two prisoners escaped from the Lucas County Jail.

On November 6, 1968, deputy sheriff Fox commenced an investigation after he was informed by a number of prisoners that they had observed the appellant with pills, nutmeg and whiskey and that he was selling these items to some of the prisoners.
