Our prior opinion in this action for infringement of plaintiff's Anderson Patent, No. 3,315,548, now Re. 26,676, disposed of all issues on the merits except the question whether the disclosures in earlier German Patent No. 974,524 rendered obvious the tempering process described in plaintiff's patent. 428 F.2d 314 (1st Cir. 1970).
