VARNER, District Judge.

Plaintiffs sue the government for wrongful deaths of their respective intestates who were killed in a helicopter crash. Plaintiffs' intestates were passengers on a military aircraft piloted by one Goss, an Army Reserve pilot who had no authority to take aboard civilian passengers, at the time of the accident resulting in the death of all three.
