FRANKEL, District Judge.

On April 5, 1951, Morton Sobell was given a maximum prison sentence of 30 years for conspiring, between 1944 and 1950, to transmit national defense (atomic bomb) information to the Soviet Union.1 On January 14, 1969, upon the basis of "good time" earned, 18 U.S.C. § 4161, he was mandatorily released, 18 U.S.C. § 4163.
