OPINION

BRETT, Judge:

Plaintiff in Error, Paul Goodwin, hereinafter referred to as defendant, was convicted by jury verdict of illegal possession of a stimulant and sentenced to the maximum of one year in jail and a fine of $500.00 in the District Court of Oklahoma County, Case No. CRM-70-164. Judgment and Sentence was imposed on March 25, 1970, and this appeal perfected therefrom.
