On an afternoon late in February, 1963, Mrs. Waltine Hoover and her mother, Mrs. E. M. Snow, were stabbed to death in their home near Double Toll Gate in Frederick County, Virginia. Seven months later, Luther Durham, Jr., petitioner, was arrested in King George County, Virginia on a charge of breaking and entering.
