This is an action for damages brought pursuant to 42 U.S.C. § 3604(d), alleging false representations and racial discrimination resulting in the eviction of plaintiffs from an apartment owned by defendants. Defendants filed a timely demand for a jury trial. Plaintiffs have moved to strike the demand, citing Rogers v. Loether, 312 F.Supp. 1008
