The defendants herein have moved under Rule 12(b) (6), Federal Rules of Civil Procedure, for dismissal of the complaint upon the grounds that it fails to state a claim for which relief can be granted. The controversy arises from proceedings instituted by the defendants, landlords, resulting in the eviction of the plaintiff, tenant.
