This is an appeal from a conviction for the crime of robbery with firearms sustained in the District Court of Muskogee County, Oklahoma. Plaintiff in error, who will hereafter be referred to as defendant, was tried by a jury, convicted and sentenced to serve ten years in the state penitentiary.
