MEMORANDUM OPINION

WILL, District Judge.

The defendants' motions to dismiss or for summary judgment present the novel question of whether notice to an interested labor union from a state applying for funds pursuant to the Emergency Employment Act of 1971, P.L. 92-54, 85 Stat. 146, is a condition precedent to approval by the Secretary of Labor of the state's application. If this question is answered in the affirmative, defendants' motions must be denied....
