Shortly after 5 a. m. on January 8, 1968, a dairy truck operated by John W. Rankin struck a mule owned by Blue Grass Boys Ranch, Inc.; the mule was being wintered on the farm of Ann Caskey Cowgill. Rankin was operating the truck eastwardly along U. S. Highway 60; he sustained personal injuries in the accident and sued Mrs. Cowgill and Blue Grass Boys Ranch, Inc., seeking compensation on account of those injuries.
