Defendant, Elbert Moore, was convicted in the Recorder's Court for the City of Detroit before a jury of the crime of unlawful possession of narcotic drugs (10 capsules containing a total of 6.25 grains of heroin hydrochloride) contrary to MCLA § 335.153 (Stat Ann 1957 Rev § 18.1123).

The defendant appeals, claiming that the evidence seized and admitted in evidence was unlawfully obtained.
