This is an appeal from the Court's order granting the Defendant's, Josam Manufacturing Company, "Motion for New Trial." We will refer to the Appellant as "Allied" and to the Appellee as "Josam" in this opinion.

Allied agreed to install an automatic scrap handling system for Josam at a price of $48,830.00. Allied started but did not complete the installation work. Josam completed it. Allied filed an "Amended Complaint" on October 31, 1969 alleging...
