Plaintiff sued defendant on a promissory note in the amount of $28,750.00, plus interest. Defendant admits liability but asserts counterclaims against plaintiff. The case was tried to a jury. At the conclusion of defendant's evidence in support of his counterclaims, plaintiff moved for directed verdicts in his favor on the promissory note and against defendant
