The appellant filed a petition for a writ of habeas corpus on December 21, 1970 in the United States District Court, wherein he alleged that his Texas state conviction for robbery by firearms was invalid because he had been subjected to double jeopardy and the evidence presented at his trial was insufficient to support the conviction. The District Court denied his petition on the ground that the appellant had failed to exhaust his available state remedies...
