On 20 January 1969, the plaintiff, Clark W. Jennings, a sixty-eight-year-old Winter Park lawyer, filed a complaint against the City of Winter Park in which he alleged that the City was liable to him on several theories including assault and battery by use of excessive force in effecting his arrest, negligence, and false imprisonment. The City's answer denied the material allegations, the cause went to trial, and a jury verdict was returned for the defendant...
