This action arose out of an automobile accident involving a truck owned by defendant-appellant, and a passenger automobile in which the plaintiff-appellee was a passenger. The accident occurred shortly after 7:00 a.m., on the morning of May 1, 1969, at which time the defendant's truck was parked in front of a restaurant on the south side of U.S. Highway 40, approximately a mile and one-half east of the city of Brazil.
