OPINION AND JUDGMENT

LATCHUM, District Judge.

Andrew J. Herhal ("Herhal"), a State prisoner, has petitioned this Court for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. He was permitted to proceed in forma pauperis.
