Plaintiff-appellee, Raymond Scholle, was riding in an automobile driven by defendant-appellant, Al Webeler. The automobile skidded on an icy spot on a country road in Ohio County, Indiana, and plaintiff was thrown from the car and injured. A trial without jury resulted in a judgment of $3,289.00 for plaintiff. Defendant's motion for new trial, which was overruled, asserts (1) the decision is not sustained by sufficient evidence, (2) the decision is contrary...
