This petition for habeas corpus was brought to obtain the discharge of the petitioner from the allegedly unlawful custody of the respondent warden. The petitioner has been in the warden's custody since March 11, 1968, at which time a justice of the Superior Court sentenced the petitioner to a term of five years for a violation of a deferred sentence.
