On November 17, 1967, the defendant was tried before a jury and convicted of the offense of breaking and entering with the intent to commit a larceny, contrary to MCLA § 750.110 (Stat Ann 1970 Cum Supp § 28.305). Defense counsel filed a motion for new trial which was denied, and defendant later filed an application for delayed appeal to this Court, which was granted.
