Suit was filed in the Circuit Court of Madison County, Alabama, by Whitesburg Center, Incorporated, against Edward F. Mersereau and Bernice M. Mersereau claiming damages for breach of a written lease. A copy of the lease was attached to and made a part of the complaint. Suit was begun on July 11, 1968. Demurrer was filed to the complaint and was overruled. Various pleas numbering 5, including a plea of recoupment in the amount of $325, were filed by...
