The plaintiff, William M. Smith, instituted this suit to recover damages for injuries sustained in an automobile collision. He joined as one of the parties defendant the Travelers Insurance Company, claiming he was an "insured" under the terms of a policy issued by the company on one of the cars involved since he was an "occupant" of the car within the meaning of the policy's uninsured motorist clause.
