BONEY, Justice.

Appellant, Eugene Parker Fields, was tried by a jury pursuant to an indictment charging him with one count of robbery1 and one count of larceny.2 At the trial, after all testimony had been heard, the defense moved to dismiss both counts of the indictment; the motions were denied.
