In 1941 appellant and her husband, James H. Lade, entered into a separation agreement in which the husband agreed to name appellant beneficiary of his interest in the New York State Retirement Fund. In 1957 he changed the beneficiary from appellant to respondent Mary Parker Lade. At his death on November 5, 1968 both applied for the benefits.
