CHASEZ, Judge.

On February 13, 1968, Alvin P. Lichtentag, The Alice Mayer Katz Trust and the M. Waldo Mayer, Jr. Trust, plaintiffs-appellants and joint owners of certain properties in the City of New Orleans, filed suit against the City to recover just compensation for properties allegedly illegally appropriated by the City of New Orleans.

The City filed a motion for summary judgment which was granted by the lower court and plaintiffs appealed.
