DYER, Chief Justice.

This case comes to this Court by grant of writ of certiorari. In this opinion the parties will be referred to as they appeared in the trial court; that is, James G. Cook, Ray Gill and Terry Gilley as plaintiffs, and Gilbert Cohen, Theodore H. Pailet, Albert G. Morris, and Evergreen Land Company, dba, Americana Apartments, as defendants.
