This action was brought by Sam S. Cutaia, appellee, against The Members Mutual Insurance Company, appellant, to recover on a policy of automobile liability insurance issued to William Smith. Cutaia had previously obtained judgment against Smith as a result of an automobile accident in which these two parties were involved.
