Frederico Medina, having waived his right to a jury, was tried by the District Court on a three-count indictment. Count one charged that Medina had knowingly smuggled marihuana into the United States in violation of 21 U.S.C. § 176a. Count two charged that he had knowingly transported and facilitated the transportation and concealment of marihuana that had been illegally brought into the United States with knowledge that it had been illegally brought...
