MATTHES, Circuit Judge.

This case reaches us on appeal by Major General Andrew P. Rollins, et al.,1 from the judgment of the district court entered on April 25, 1969, granting a writ of habeas corpus and ordering appellee discharged from custody.2 We affirm.

All relevant facts were stipulated, and the cause was eventually submitted on appellants' motion for summary judgment.
