SPALDING, J.

The defendant was convicted under an indictment charging him with being an accessory after the fact to the crime of kidnapping. G.L.c. 274, § 4. The indictment was tried with two indictments, in which Charles J. Flynn and Paul Souza, respectively, were charged with the crime of kidnapping. The trial was subject to G.L.c. 278, §§ 33A-33G. The case is here on Eagan's appeal.
