Under review is a judgment based upon a jury verdict in the sum of $8800 awarded plaintiff, Virginia Rivers Martin, against defendant, William David Biggs, for negligence. Plaintiff was a paying passenger in an automobile operated by Madeline Koger Shively which was struck from the rear, while stopped, by an automobile operated by Biggs.
