OPINION

POWERS, Justice.

This civil action was instituted in the Newport County Superior Court for the purpose of having a purported amendment to the Jamestown zoning ordinance declared null and void. It was heard by a justice of said court on the plaintiffs' motion for summary judgment, and from the entry of such judgment, the defendant seasonably appealed to this court.
