ZENOFF, Justice.

Jess Mayer was convicted of selling narcotics to Sheila Summers, an undercover agent for the Reno police. At issue on this appeal is the state's utilization of evidence of marijuana that was not part of the sale but which was seized in Mayer's apartment after his arrest which took place on the street. When Mayer handed Sheila two lids of the narcotics she told him she was $5.00 short of the agreed price and he volunteered to wait...
