McCOWN, Justice.

This is an action for damages for personal injuries sustained by the plaintiff as the result of a fall in defendant's hotel. The jury verdict was for the defendant and the plaintiff has appealed.

The sole assignment of error is that the trial court failed to give an instruction on the statutory comparative negligence rule. There was also no instruction on contributory negligence, although that issue was raised by the pleadings and the evidence...
