MEMORANDUM OPINION

BUSSEY, Judge.

John Lee Magness, hereinafter referred to as defendant, was charged, tried, and convicted in the District Court of Tulsa County for the crime of Unauthorized Use of a Motor Vehicle. He was sentenced to a term of one to three years imprisonment, and from said judgment and sentence a timely appeal has been perfected to this Court.
