BRADLEY, Judge.

An action was filed in the Circuit Court of Macon County against the surety on the official bond of the Sheriff of Henry County for acts allegedly committed by one of the Sheriff's deputies. A demurrer was filed to the complaint and overruled. A plea in short by consent was then filed, and trial ensued before the court and a jury.
