By stipulation of the parties, the specific issue raised by the defendant Hertz' affirmative defense, of lack of permissive use of the vehicle owned by it, was tried by the court without a jury. All other issues as to liability and damages were reserved for further disposition in this court or through MVAIC procedures dependent upon the determination of this affirmative defense.
