ORDER

In the case of Smith v. Hooey, 393 U.S. 374, 89 S.Ct. 575, 21 L.Ed.2d 607, the petitioner was indicted in 1960 on a Texas criminal charge. He was then a prisoner in a federal penitentiary. The Texas Supreme Court denied his mandamus petition reqeusting a show cause order why the charge should not be dismissed. The United States Supreme Court, on a petition for certiorari, held that the Sixth Amendment right to a speedy trial...
