Allen Woods, age 10, was injured when struck by an automobile owned and operated by the defendant, Dominic C. Cappo. The trial judge held that Mr. Cappo was negligent in that he failed to exercise the high duty of care required of a motorist when that motorist sees or should have seen a child on or about a major thoroughfare.
